AANP Seeks Revision to Insurance Model Act

The National Association of State Insurance Commissioners (NAIC) is updating its Managed Care Plan Network Adequacy Model Act, which has not been revised in 18 years. Most of the written comments so far have come from state insurance departments and from associations representing physicians, pharmacists, and insurance companies.

AANP took an important step to remedy this imbalance by submitting formal comments on December 9. We requested that the Model Act include language that is identical or substantially similar to Section 2706 of the Affordable Care Act. Such language would not only reflect Federal law but underscore that the phrase used in the statute – “participation under the plan” – is an integral part of network adequacy.

These comments reflect AANP’s commitment to pursue insurance provider non-discrimination as clearly intended by Congress through Section 2706. If you would like a copy, please email staff.
